Major Code of Conduct
A violation of any of the following rules will result in disciplinary action, including in-school suspension, suspension, expulsion, removal, probation, evening school, detention or referral to the court system. Use of Evening School and in-school suspension as a substitute for out of school suspension will be at the discretion of the administrator. (AES)
Rule 1: Major Disruption of or Interference with Curricular or Extracurricular Activities - A student shall not by use of violence, force, coercion, threat, demonstration, false alarm, vulgar or obscene language or gestures or printed material, ignition of firecrackers, ignition of fires, distribution of printed matter which may incite others to violent or disruptive conduct, or in any other manner cause material disruption or interference with curricular or extra-curricular activities. Anyone calling in a bomb threat or setting off an unwarranted fire alarm will be turned over to the police department for prosecution.
1st offense: 3-10 days suspension (AES) 2nd offense: 5-10 days suspension, possible expulsion 3rd offense: Recommend expulsion
Rule 2: Damage of Property - A student shall not intentionally cause or attempt to cause damage to the school, school property, or private property either on school grounds or during a school activity. Additionally, damage to property at any time while under school jurisdiction will require full restitution and a possible referral to civil authorities.
1st offense: 1-10 days suspension (AES) 2nd offense: 2-10 days suspension (AES) 3rd offense: 10 days suspension with possible expulsion 4th offense: 10 days suspension and recommended expulsion
Rule 3: Fighting/Hitting/Unauthorized Touching - Fighting, hitting, pushing, or unauthorized touching are treated seriously because the size and strength of older students increases the risks of serious harm to one or both parties. This rule covers physical contact that is initiated against another student with the intention of doing harm to that individual (Section B), and will result in an out of school suspension and possible charge. Returning Section B with physical force will be considered fighting and will be treated with a suspension. An option for an Alternative Educational Setting may be exercised by the administrator in charge.
A. Threats (Student to Student)
1st offense: Warning from administrator or referral to Guidance and possible 1-3 day suspension 2nd offense: 2 day suspension (AES) 3rd offense: 3 day suspension 4th offense: 10 days suspension and recommended expulsion B. Physically Hitting or Unauthorized Touching (Student to Student) - Possible referral to civil authorities.
1st offense: 3 day suspension and possible referral 2nd offense: 5 day suspension 3rd offense: 10 days suspension and recommended expulsion C. Threats and/or Physically Hitting or Unauthorized Touching a School Employee
1st offense: 10 days suspension pending expulsion and referral to civil authorities D. Fighting (Both parties involved in hitting/unauthorized touching) - Possible referral to civil authorities.
1st offense: 3 days suspension (AES) 2nd offense: 5 days suspension 3rd offense: 10 days suspension 4th offense: 10 days and recommended expulsion E. Use of Weapon in A, B, C, or D above
1st offense: 10 days suspension pending expulsion and referral to civil authorities
Rule 4: Possession of Dangerous Weapons and Instruments - A student shall not posses or conceal upon his person or on school property or at school functions, an instrument or weapon capable of harming another person. Included in this prohibition would be the use of chemicals and gases, mace, fireworks, or powder charges, ammunition, or any other weapon. (Possession or concealment of firearms or weapons will be dealt with as a third offense.) - Possible referral to civil authorities.
1st offense: 5-10 days suspension and possible expulsion 2nd offense: 10 days suspension and recommend expulsion
Rule 5: Disrespect - No student shall at any time show a lack of respect to any classmate, teacher, administrator or staff member. Examples could be making disparaging (degrading) remarks, being outwardly sarcastic, or saying things to achieve a derogatory effect.
1st offense: 1-5 days suspension (AES) 2nd offense: 2-10 days suspension (AES) 3rd offense: 5-10 days suspension 4th offense: 10 days suspension and recommended expulsion
Rule 6: Insubordination - A student shall not disregard or refuse to obey reasonable direction or instructions given by school personnel while the student is properly under the authority of the school. Repeated violations of any minor rule directive or discipline procedure may be considered insubordination.

Rule 7: Violation of Civil Ordinances While Under School Authority - A student shall not violate any law or ordinance while under the authority of the school or its personnel. (School discipline as appropriate and civil or criminal charges filed.)
Rule 8: Harassment, Intimidation, Bullying, Hazing - NO student shall use any gesture, written, verbal, or physical act to degrade, disgrace, or demean another student. This includes topics that will insult, intimidate or place a student in fear of being harmed by another student or group of students either physically or mentally.
1st offense: 1 Evening School 2nd offense: 1 - 2 days suspension (AES) 3rd offense: 5 days suspension 4th offense: 10 days suspension and recommend expulsion
Rule 9: Use of Profanity/Obscenity - A student shall not use profanity or obscene language either written or oral in communicating with other students or visitors. Included in this prohibition would be the use of obscene gestures, signs, pictures, publications, or possession of pornographic materials. (Use of profanity/obscenity directed at school personnel will be considered under the 3rd offense)
1st offense: Discretion: (warning to 1 day suspension (AES) 2nd offense: 2 days suspension (AES) 3rd offense: 5 days suspension 4th and subsequent offenses: 10 days suspension
Rule 10: Theft - Includes public property or equipment of the school district or the personal property of another student, teacher, visitor, or employee of the school district. In all cases, the student will make restitution to the injured party and possible referral to civil authorities.
1st offense: 2 days suspension and possible referral to proper civil authorities (AES) 2nd offense: 3 days suspension 3rd offense: 5 days suspension 4th offense: 10 days suspension and recommend expulsion
Rule 11: Inappropriate Display of Affection or Improper Social Behavior - Necking, petting, kissing, holding hands, etc. A student shall not expose any part of his/her anatomy in any inappropriate manner while under jurisdiction of the school (considered under 2nd or 3rd offense).
1st offense: Conference with administrator and a note or call to parent(s) and possible 1-3 day suspension (AES) 2nd offense: 1-5 days suspension (AES) 3rd offense: 10 days suspension and possible expulsion
Rule 12: Repeated Violation of Minor Misconduct Rules - A student shall not repeatedly violate the minor misconduct rules. Repeated violations of the minor misconduct rules during the same school year may be treated as a major violation of this Code and may result in suspension or expulsion.
Rule 13: Distribution of Unauthorized Printed Materials - Printed materials that are distributed at school must first be checked and cleared through the office. Material that could degrade, disgrace, disrupt or be offensive would not be allowed.

Rule 14: Failure to Sign-in or Sign-out of office - All students must sign in or sign out when entering or leaving at irregular times, but signing in or signing out does not excuse you. Students must be on the early dismissal list or have permission from the administration to leave.
Each occurrence: Insubordination (Rule 6)
Rule 15A: Truancy - Any student who misses or is absent from any assigned period of their schedule without permission, or fails to meet the requirements of an approved excuse for an absence under the attendance guidelines will be considered as truant. This rule would also include students who leave class without permission.
1st offense: 2 days suspension (AES)
2nd offense: 3 days suspension (AES)
3rd offense: 5 days suspension
4th offense: 5 days suspension
5th offense: 10 days suspension and charges filed
Rule 15B: Tardy - No student shall for any reason be late to any assigned period of the school day. A student will be considered tardy to school if he/she has not checked in with the appropriate staff member before 7:25 a.m. and also will be considered tardy if they do not arrive to a specific class within the allotted exchange time. Being late to 1st period class for the purpose of attending breakfast will not be considered an excused tardy. If a student is tardy they will be asked to report to the main office to receive a pass. This is important since students are counted absent until they sign in. Multiple tardiness during a single trimester, will result in discipline steps listed below:
1st offense: Verbal Warning
2nd offense: Lunch Detention
3rd offense: Detention & Parent contact
4th offense: Evening School
5th offense: Friday School
6th offense: 1 day ISS and a truancy hearing with school administration
7th offense: Referral to Warren County Juvenile Courts

Rule 16: Abidance with Sanctions - A student shall not refuse to abide by any punishment meted out by the school administration, or any teacher, or any court order related to school activities.
Rule 17: Driving - Junior High students may not drive any motorized vehicles on school property.
Rule 18: Possession and/or Concealment of Matches or Lighter
1st offense: 1 day suspension (AES) 2nd offense: 2 days suspension (AES) 3rd offense: 3 days suspension 4th offense: 5 days suspension
Rule 19: Possession, Concealment or Use of Tobacco or Tobacco Products - Referral to civil authorities.
1st offense: 3 days suspension (AES) 2nd offense: 5 days suspension 3rd offense: 10 days suspension 4th offense: 10 days suspension and recommend expulsion
Rule 20: Possession or Concealment of Drug Instruments of Paraphernalia (Includes roach clips, scales, eye droppers, hypodermic needles, bongs, coke spoons, etc.)
1st offense: 3 days suspension (AES) 2nd offense: 5 days suspension 3rd offense: 10 days suspension and recommend expulsion
Rule 21: Drug & Alcohol Policy - It is the philosophy and intent of the Little Miami Board of Education and administration to discourage use or possession of drugs and alcohol. A student shall not possess, use, conceal, or show signs of consumption of narcotics, drugs, or alcohol on school grounds, school buses, or attending any school related function. Possession, use, or showing signs or evidence of having used drugs or alcohol - referral to civil authorities
1st offense: 10 days suspension (option for expulsion is at administrator's discretion) 2nd offense: 10 days suspension and recommend expulsion However, the student may be reinstated if documented evidence is submitted to the principal or his designee that an assessment has been made or scheduled with an Alcohol and Drug Abuse Center or a similar agency. The student must follow the recommendation of the assessment. If the assessment is scheduled and followed, 5 days of the suspension may be lifted. If the student does not make contact with a drug and alcohol agency for help within this ten (10) day period, he/she may go through an expulsion hearing with the possibility of being expelled. If during the recommended treatment program the student fails to meet the outlined requirements of the program he/she will again be suspended out of school for ten (10) days and there will be a request for expulsion.
It will be possible for a student to use the counseling and/or rehabilitation for one time only as a means to avoid expulsion. If the student once again possesses, uses, conceals, or shows evidence of having used narcotics, drugs, or alcohol, she/he will be suspended out of school for ten (10) days and there will be a request for their expulsion.
When in the case of possession or concealment there is a sufficient amount of narcotics, drugs or alcohol for the local or county law enforcement official to file charges, the student will be immediately suspended from school for ten (10) days and there will be a request for their expulsion.
Sale, Transfer or Distribution of Alcohol, Drugs, or Look-a-Like Drugs - Referral to civil authorities.
1st offense: 10 days suspension and recommend expulsion A student shall not transfer, sell, attempt to sell or deliver narcotics, drugs, or alcohol while on school grounds or attending any school related function. If this does occur, the penalty will be an immediate ten (10) day out of school suspension with a request for expulsion. Note: This penalty applies to transferring, selling, attempting to sell or delivering a non-controlled substance which is represented to be a controlled substance or is packaged in a manner normally used for illegal delivery of a controlled substance while on school grounds, on the school buses, or attending any school related function. This part of the policy does not apply to possession or proper use of prescription drugs under a doctor's care. (See Board of Education Policy JFCH)
Rule 22: Other Conduct - A student shall not engage in any type of conduct not specifically set forth above which is harmful to the person or property of school personnel or other students or which conduct is not in compliance with socially accepted standards of behavior.
Rule 23: Aiding and Abetting in the Commission of a Violation of Rules 1 Through 23 - A student shall not aid or abet another student in the commission of a violation on any one of Rules 1 through 26.
Rule 24: Falsifying Information - No student shall falsify communicated information provided to school personnel during the course of legitimate job pursuits.
Rule 25: Sexual Harassment - No student shall engage in any activity that results in unwanted sexual advances or unwanted visual, verbal or physical contact of a sexual nature with another student. Anyone who falsely accuses another person of any type of sexual harassment will be subject to disciplinary action.
1st offense - application of consequences at any level will remain at the discretion of the administration which may include but are not limited to conference, warning, parent contact, detention, alternative educational setting or suspension 2nd offense - 3 days suspension (AES) 3rd offense - 5 days suspension 4th offense - 10 days suspension and possible recommendation for expulsion
Rule 26A: Possession of Electronics, Pagers, laser pointers, cell phones - These items are not allowed during the school day, school activity, or on the school bus. These devices will be confiscated, and returned to parents only. After 30 days the district may dispose of unclaimed items.
1st offense Confiscated and returned to parent
2nd offense: 2 detentions
3rd offense: 1 Evening School
4th offense: 1-2 days suspension (AES)
5th offense: 5 days suspension
